How Does Collaborative Divorce Work?

If you choose collaborative divorce, you and your spouse will each have a lawyer. You will both sign a document agreeing to find a solution to each issue and reach a settlement. If you cannot reach a settlement, your lawyers must withdraw from the case and your divorce will go to trial. You must each select new lawyers for the trial.

For many couples, collaborative divorce is a better option than traditional litigation. The process is not adversarial. Instead, you and your spouse will work with your lawyers to reach an agreement on issues such as property division, support and child custody.

When necessary, additional professionals are brought in to help couples work through their disputed issues. Depending on the specifics of the case, divorce coaches, financial coaches and behavior health professionals may work with you to help you communicate better.

If you and your spouse reach a settlement, a judge will finalize it and the divorce will be complete. When collaborative divorce works this way, it is typically less expensive and less time-consuming than a trial. It also helps you to preserve relationships since the emphasis is on working together.
