What Are Common Misconceptions In Family Law?
It’s all too easy to get incorrect advice about divorce and family law. Well-meaning friends, family and co-workers who have been through divorce or custody matters may think that they know how it works, but the laws change constantly. Also, friends in another state may understand how things work where they live, but not in Pennsylvania.
Don’t let misinformation hurt your family law case or cause you unnecessary stress – rely only on our legal professionals. Talk to one of our experienced, caring attorneys if you have questions. We have offices in Johnstown, Somerset and Windber.
Myths About Pennsylvania Family Law
You must be legally separated before you can divorce. Many people believe you need a “legal separation” in Pennsylvania before you can get a divorce. This is confusing because there is no such thing as a “legal separation” in Pennsylvania. The lengthy of the “physical separation” of the parties is one important factor that is considered before a divorce action can move forward, but it is not the only factor.
Marital property is divided 50-50. An “equitable” division of property does not necessarily mean the assets will be divided equally. An equitable distribution of assets is one that the court considers fair. The court must consider a list of factors in determining how the marital assets will be distributed. Each case is unique.
Grandparents do not have rights. Every state is different. In Pennsylvania, grandparents and great-grandparents can file a custody action if they meet certain criteria and under specific circumstances. The same standard applies to this as it does to any custody case: The court considers what is in the best interests of the child.
There is a specific age when children can choose who they want to live with and when they will have contact with the other parent. This is the most common misconception. There is no such magic age in the law that confers these rights upon a child. The court must consider the preference of the child if they are mature enough to state an opinion, but the court is not bound by their preference.
